Case Dismissed
Elon Musk has stopped his lawsuit against OpenAI, which he co-founded, along with its leaders, Sam Altman and CEO Brian Brockman. CNBC reported that the case was dismissed with prejudice, meaning it cannot be refiled.
Original Lawsuit
Musk filed the lawsuit in February, accusing OpenAI and its leaders of betraying him and breaking an agreement in 2019. He claimed they had strayed from their mission of creating AI to benefit humanity and instead had turned into a for-profit company mainly controlled by Microsoft.
Avoided Court Hearing
By withdrawing the lawsuit, Musk avoided a court hearing scheduled for Wednesday in San Francisco. At this hearing, a judge was supposed to decide whether to dismiss the case.
Legal Experts’ Views
Legal experts on a CNBC show had questioned the strength of Musk’s case. They pointed out that the agreement Musk referred to wasn’t a formal written contract signed by all parties involved.

In his 35-page complaint, Musk emphasized his key role in creating OpenAI. He highlighted how the company has now become very successful, especially with the popularity of its ChatGPT application. This success has further solidified OpenAI’s position in the AI industry.
Kevin O’Brien’s Legal Expert’s Opinion
Kevin O’Brien, a partner at Ford O’Brien Landy LLP and a former assistant U.S. attorney, commented on Elon Musk’s lawsuit against OpenAI. He said, “It’s certainly a good advertisement for the benefit of Elon Musk. I’m not sure about the legal part though.” This suggests that while the lawsuit might have helped Musk’s public image, its legal basis was questionable.
Musk’s New AI Startup
Elon Musk has started his own AI company, xAI, to compete with OpenAI. xAI recently raised $6 billion in a Series B funding round. Notable investors include Andreessen Horowitz, Sequoia Capital, and Fidelity Management & Research Company.
According to its website, xAI aims to “understand the true nature of the universe.” The company introduced Grok’s chatbot, inspired by “The Hitchhiker’s Guide to the Galaxy.” Grok has real-time internet knowledge and was trained for two months to be effective.
